Nothing in these Terms affects your statutory rights under applicable UK consumer law.
2. Using our website
You may use our website only for lawful purposes.
You must not use the Services:
-
for any unlawful or fraudulent purpose;
-
to infringe our intellectual property rights or those of another person;
-
to transmit viruses, malware or other harmful material;
-
to interfere with the security or operation of the website;
-
to collect or misuse the personal information of others;
-
to send spam or other unauthorised communications; or
-
in any way that could damage, disable or impair our website or Services.
We may restrict or suspend access to the Services where reasonably necessary to protect our website, customers or business.
3. Our products
We make reasonable efforts to ensure that product descriptions, photographs, prices and other information on our website are accurate.
Colours and appearance may vary slightly depending on your screen, device or display settings. Packaging may also occasionally vary from images shown where this does not materially change the product you have purchased.
Our products are subject to availability, and we may limit quantities or discontinue products.
Products supplied to consumers will be as described, of satisfactory quality and fit for their usual purpose in accordance with applicable UK consumer law.
Nothing in these Terms limits your statutory rights in relation to faulty, damaged, unsafe or incorrectly described products.
4. Orders
When you place an order through our website, you are offering to purchase the products in your order.
After placing an order, you will receive an order confirmation at the email address you provided.
We reserve the right to decline or cancel an order where there is a reasonable reason to do so, including where:
-
a product is unavailable;
-
there is an obvious pricing or product-information error;
-
payment cannot be authorised;
-
we reasonably suspect fraudulent or unauthorised activity; or
-
we are unable to fulfil the order for another legitimate reason.
If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled items and any applicable delivery charges.
Please check your order details carefully before submitting your order and contact us as soon as possible if you notice an error.
5. Prices and payment
Prices are shown in Pounds Sterling (GBP) unless otherwise stated.
The price you pay will be the price displayed when you place your order, subject to the correction of obvious pricing errors.
Any applicable delivery charges will be clearly displayed before you complete your purchase.
Payment is processed securely through Shopify and the payment providers available through our checkout.
You confirm that you are authorised to use the payment method provided for your purchase.
6. UK delivery
We currently deliver to addresses within the United Kingdom where delivery is available through our checkout.
UK delivery is free on orders of £24.95 or more.
Orders below the free-delivery threshold are subject to the delivery charge shown at checkout.
Orders are sent using Royal Mail Tracked 48 unless otherwise stated.
Delivery times shown on our website are estimates and may occasionally be affected by circumstances outside our reasonable control.
We remain responsible for the goods until they are delivered into your physical possession, or into the physical possession of another person you have identified to receive them, except where applicable law provides otherwise.
If there is a problem with your delivery, please contact us at phin.wave.coffee@gmail.com.
7. Returns, cancellations and refunds
Your rights to cancel an order, return eligible products and receive refunds are explained in our Refund Policy.
For eligible change-of-mind returns, you generally have 14 days after receiving your order to tell us that you wish to cancel or return it, as described in our Refund Policy.
Opened coffee cannot normally be returned for a change of mind for food safety and hygiene reasons.
This does not affect your statutory rights if a product is faulty, damaged, unsafe, incorrect or not as described.
Please read our Refund Policy for full information about eligibility, return postage and refunds.
8. Damaged, faulty or incorrect products
Please contact us as soon as reasonably possible if your order arrives damaged, faulty, incorrect or not as described.
We will work with you to resolve the issue in accordance with your rights under applicable UK consumer law.
Nothing in these Terms or our Refund Policy excludes or restricts rights that cannot lawfully be excluded or restricted.
9. Product information and coffee
Information provided on our website about coffee, brewing methods, flavour, strength and preparation is intended to help customers understand and enjoy our products.
Taste and brewing results may vary depending on factors such as preparation method, water, equipment and personal preference.
Any general information provided through our website or content is not intended as medical or health advice.
Please refer to the product packaging and product page for relevant product information.
10. Intellectual property
Unless otherwise stated, the content of the Phin Wave Coffee website, including our branding, logos, photographs, graphics, text, videos, designs and other original content, is owned by or licensed to Phin Wave Coffee Ltd and is protected by applicable intellectual property laws.
You may access and use our website for personal, non-commercial purposes.
You may not reproduce, distribute, modify, republish, sell or commercially exploit our content without our prior written permission, except where permitted by law.

11. Reviews, feedback and customer content
If you voluntarily submit a review, photograph, comment or other content to us or through functionality on our website, you confirm that you have the right to provide that content.
Where you submit content for publication, you grant us a non-exclusive, royalty-free licence to use, reproduce and display that content in connection with operating and promoting Phin Wave Coffee and our products.

Our website uses third-party services and integrations to help us operate our business, including Shopify and services relating to payments, fulfilment, shipping, analytics and marketing.
Our website may also contain links to third-party websites.
We are not responsible for the content, availability or privacy practices of third-party websites that we do not operate or control.
Our use of personal information and relevant third-party service providers is explained further in our Privacy Policy.

Please review our Privacy Policy for further information.
14. Errors and availability
We make reasonable efforts to keep the information on our website accurate and up to date.
Occasionally, information relating to product descriptions, pricing, availability, promotions, delivery or other aspects of the Services may contain an error.
Where we identify an error, we may correct or update the relevant information.
If an error materially affects an order you have already placed, we will contact you where appropriate and provide any options or remedies required by applicable law.
15. Availability of the website
We aim to keep our website and Services available and functioning correctly, but we cannot guarantee that the website will always be uninterrupted or error-free.
We may temporarily suspend or restrict access for maintenance, security, technical reasons or circumstances outside our reasonable control.
Nothing in this section limits any rights you have in relation to products you have purchased from us.
16. Liability
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
In particular, nothing in these Terms excludes or limits:
-
liability for death or personal injury caused by negligence;
-
liability for fraud or fraudulent misrepresentation;
-
your statutory rights relating to goods, including your rights where goods are faulty, not as described or not of satisfactory quality; or
-
any other liability that cannot legally be excluded or limited.
Subject to the above, we are not responsible for losses that were not reasonably foreseeable when the contract was entered into or losses resulting from circumstances outside our reasonable control.
We do not exclude or restrict liability in a way prohibited by UK consumer law.
17. Changes to the Services
We may update, change or discontinue parts of our website or Services from time to time.
Changes will not affect rights you have already acquired under an existing order or contract unless permitted by law.
18. Changes to these Terms
We may update these Terms from time to time to reflect changes to our Services, business practices or applicable law.
The latest version will be published on this page together with the date it was last updated.
The Terms applicable to an order are generally those in effect when the order was placed, unless applicable law requires otherwise.
19. Severability
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as modified or removed only to the extent necessary.
The remaining provisions will continue to apply.
20. Governing law
These Terms and any contract between you and Phin Wave Coffee Ltd are governed by the laws of England and Wales.
If you are a consumer resident elsewhere in the United Kingdom, you will continue to benefit from any mandatory protections available to you under the laws applicable where you live.
Nothing in this section limits any rights you may have regarding where you are entitled to bring legal proceedings as a consumer.
